After the elimination of the federal individual mandate under the Affordable Care Act by Congress, the state of Vermont has implemented an individual mandate at the
state level.
The Individual mandate, effective from January 1, 2020, requires most Vermont residents over the age of 18 to acquire health insurance coverage and submit their 2024 tax forms. This verifies whether or not they maintained ACA compliant insurance during the 2023 tax year.
Currently, Vermont has not implemented any penalty for individuals who fail to maintain
ACA-compliant health insurance coverage in 2023.
The Employer Responsibility for Vermont’s Individual Health Care
Mandate Reporting
Vermont has yet to officially release any additional reporting requirements for employers. Currently, employers are only required to report information to the State in the event that the federal ACA reporting requirements are eliminated.
